Terms of Service

These Terms of Service ("Terms") govern your use of the Subtext application and website ("Service"), operated by Subtext UG (haftungsbeschränkt) ("we", "us"), registered in Berlin, Germany. By using the Service, you agree to these Terms.

1. What Subtext Is (and Isn't)

Subtext analyzes chat conversations using artificial intelligence to generate communication insights, pattern analysis, and narrative reports. Subtext is not therapy, counseling, or professional mental health advice.

Our AI generates observations about communication patterns — not diagnoses, not treatment recommendations, not clinical assessments. The insights we provide are based on text analysis and should be treated as one perspective, not absolute truth.

If you or someone you know is in crisis or experiencing abuse, please contact a qualified professional or local emergency services. Subtext is a mirror, not a therapist.

2. Eligibility

• You must be at least 16 years old to use the Service.
• By using the Service, you represent that you have the legal capacity to enter into these Terms.

3. Your Account

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity under your account.
• We reserve the right to suspend accounts that violate these Terms.

4. Your Data

Ownership

You retain full ownership of the chat data you upload. By uploading, you grant us a limited, non-exclusive license to process it for the sole purpose of providing the Service (analysis, reporting, insights). We do not claim ownership of your data.

Consent to Upload

When you upload a chat conversation, you represent that:

• You are a participant in the conversation.
• You have the legal right to access the exported conversation data on your device.
• You understand that the analysis covers both sides of the conversation.

In "Together" mode, both participants must actively opt in before shared analysis is generated.

Deletion

You may delete your data at any time through the app. Deletion removes all uploaded chat exports, generated reports, and associated insights. Aggregated, anonymized statistical data (e.g., average response times across all users) may be retained. See our Privacy Policy for details.

5. Acceptable Use

You agree not to use the Service to:

• Upload conversations you are not a participant in (stalking, surveillance).
• Harass, intimidate, or harm another person using insights from the Service.
• Upload content depicting or involving minors.
• Attempt to reverse-engineer, decompile, or extract the AI models or algorithms.
• Use the Service for any purpose that violates applicable law.
• Circumvent usage limits, rate limits, or access controls.

We reserve the right to terminate accounts that violate these terms without notice.

6. Payments and Refunds

In-App Purchases

Paid features are purchased through the Apple App Store or Google Play Store. Payment processing and subscription management are handled by the respective platform. Refund policies are governed by Apple and Google's terms.

One-Time Purchases (Reflect)

The Reflect analysis is non-refundable once the AI report has been generated, as it incurs real processing costs. If the report generation fails, you will receive a full refund or credit.

Subscriptions

Subscriptions (Decode, Together, Guided) auto-renew unless cancelled. You can cancel at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.

7. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee the accuracy, completeness, or usefulness of any AI-generated insights.
• We are not liable for any decisions you make based on Subtext insights.
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, consequential, or punitive damages.

8. Intellectual Property

The Service, including its design, code, AI models, and branding, is owned by Subtext UG. You may not copy, modify, distribute, or create derivative works based on the Service except as expressly permitted.

You retain ownership of your data. AI-generated reports are licensed to you for personal use. You may share your own reports via the sharing feature. You may not commercially distribute or resell reports.

9. Termination

You may stop using the Service at any time. We may terminate or suspend your access if you violate these Terms. Upon termination, we will delete your data in accordance with our Privacy Policy.

10. Governing Law

These Terms are governed by the laws of Germany. Disputes will be resolved in the courts of Berlin, Germany — except where mandatory consumer protection laws require your local jurisdiction.

11. Changes to These Terms

We may update these Terms. We will notify registered users of material changes at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance of the updated Terms.
